Hearing the dispute over Krishna Janmabhoomi, the Supreme Court on Tuesday stayed the Allahabad High Court’s order appointing a commissioner to inspect the Shahi Eidgah masjid in Mathura.
Hearing the petition filed by the mosque committee against the High Court order, a bench comprising of Justices Sanjiv Khanna and Dipankar Datta stayed the December 14 High Court order appointing a court commissioner to inspect the mosque.
The Allahabad High Court had allowed a court-monitored survey of the mosque premises. The court agreed to the appointment of an advocate commissioner to oversee the survey, which the petitioners claim holds signs suggesting that it was a Hindu temple once.
The bench observed there are certain legal issues which have arisen and questioned the vague application made before the high court for the appointment of a court commissioner for the survey.
“You can’t file a vague application for appointment of court commissioner. It should be very specific on the purpose. You can’t leave everything to the court to look into it,” the bench told senior advocate Shyam Divan, appearing for Hindu bodies like Bhagwan ShriKrishna Virajman and others.
